Illinois Bill Would Limit AI in Health Insurance Decisions

I’ve introduced legislation to make sure that artificial intelligence cannot deny or reduce health insurance coverage without meaningful human oversight.

Under my proposal, insurance companies would be prohibited from making adverse decisions — such as denying, reducing, or terminating benefits — solely based on AI or predictive models. Any such decision would require a real review by a human decision-maker with authority to override the AI.

This bill empowers the Illinois Department of Insurance to regulate insurers’ use of AI, investigate unfair practices, and establish clear rules for accountability and transparency. The goal is to protect patients and consumers from inappropriate, opaque algorithm-based determinations that could put their health and financial stability at risk.

Supporters, including medical and consumer advocates, agree that when it comes to health care, human judgment must remain central. Industry groups, however, have raised concerns about potential regulatory burdens.
